Terms of Service

By accessing or using How's Today? (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms constitute a legally binding agreement between you and How's Today? ("the Company").

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

How's Today? is a communication tool only.

• No Medical Advice: The Service does not provide medical advice, diagnosis, or treatment. All content and status updates are for informational and communication purposes between users.
• No Emergency Monitoring: The Company does NOT monitor status updates. The Service is NOT an emergency response system.
• Not a Life-Safety Tool: The Service should never be relied upon as a substitute for professional medical care or emergency services. If you are in a life-threatening situation or experiencing a medical emergency, you must contact emergency services (e.g., 911) immediately.

• Eligibility: You must be at least 13 years of age to use the Service.
• Patient Codes: Access to your status is controlled via "Patient Codes." You are solely responsible for maintaining the confidentiality of your code and for any activity that occurs under your account. The Company is not liable for unauthorized access resulting from you sharing your code.

You agree not to use the Service to:

• Harass, abuse, or stalk caregivers or patients
• Upload or transmit viruses or malicious code
• Impersonate any person or entity, including medical professionals

The Service, including its original content, features, "look and feel," and functionality, are and will remain the exclusive property of the Company and its licensors.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, or materials included therein.

• We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
• We do not guarantee that a notification will be delivered to a caregiver successfully or in a timely manner.

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, or use
• Personal injury or wrongful death resulting from the use or inability to use the Service
• Any reliance placed by you on the completeness or accuracy of the Service
• Any failure of the Service to send or receive a status update

In no event shall the Company's total liability exceed the amount paid by you, if any, for accessing the Service.

You agree to defend, indemnify, and hold harmless the Company and its employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or your violation of these Terms.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

We reserve the right to modify these terms at any time. We will notify you of changes by posting the new terms within the App. Your continued use of the Service after changes are posted constitutes acceptance of the new terms.
